{"id":1820,"date":"2021-12-29T12:37:13","date_gmt":"2021-12-29T16:37:13","guid":{"rendered":"http:\/\/ielrblog.com\/?p=1820"},"modified":"2021-12-29T12:37:13","modified_gmt":"2021-12-29T16:37:13","slug":"saif-al-islam-gaddafi-allowed-to-run-for-libyan-presidency-despite-war-crimes-conviction","status":"publish","type":"post","link":"https:\/\/ielrblog.com\/index.php\/2021\/12\/29\/saif-al-islam-gaddafi-allowed-to-run-for-libyan-presidency-despite-war-crimes-conviction\/","title":{"rendered":"Saif al-Islam Gaddafi Allowed to Run for Libyan Presidency Despite War Crimes Conviction"},"content":{"rendered":"<p>A court in Libya has approved Saif al-Islam Gaddafi, son of the late dictator Muammar Gaddafi, to run in the upcoming presidential election.<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a>\u00a0 Experts believe that Gaddafi may be able to win the support of Libyans that yearn for the stability of his father\u2019s regime before the civil war.\u00a0 Other Libyans are outraged that Gaddafi can run in the election despite his prior conviction for war crimes during the revolution.<\/p>\n<p>&nbsp;<\/p>\n<p><em>History of the Gaddafi Family<\/em><\/p>\n<p>Colonel Muammar Gaddafi ruled Libya for 42 years, his son serving as his right-hand man and heir-apparent.<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a>\u00a0 Muammar Gaddafi was overthrown in a bloody civil war in 2011, caused by a NATO-backed intervention and Libyan protests as part of the Arab Spring.<a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a>\u00a0 Without structural plans of what was to come after the regime, Libya fractured into regional militias that utilized force to obtain political power.<a href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a>\u00a0 Today, control of Libya is split between the official government and the Libyan National Army, with ISIS maintaining a sizeable influence in the country.<a href=\"#_ftn5\" name=\"_ftnref5\">[5]<\/a>\u00a0 The upcoming presidential election is thought to be a crucial factor in bringing the country political stability and ending its 10-year crisis.<\/p>\n<p>&nbsp;<\/p>\n<p>After his father\u2019s fall in 2011, Saif al-Islam Gaddafi was captured by a Libyan revolutionary militia.\u00a0 In 2015, he was sentenced in absentia to the death penalty for war crimes, including killing protestors during the revolution.<a href=\"#_ftn6\" name=\"_ftnref6\">[6]<\/a>\u00a0 He was held captive in the northwestern town of Zintan until his release in 2017.<a href=\"#_ftn7\" name=\"_ftnref7\">[7]<\/a>\u00a0 Gaddafi\u2019s sentence was eventually overturned for violations of due process and the United Nations called on Libyan authorities to surrender Gaddafi to the International Criminal Court (ICC).<a href=\"#_ftn8\" name=\"_ftnref8\">[8]<\/a>\u00a0 As of December 2021, Gaddafi still has not been brought to the ICC and is still wanted for crimes against humanity committed during the civil war.<a href=\"#_ftn9\" name=\"_ftnref9\">[9]<\/a><\/p>\n<p>&nbsp;<\/p>\n<p>After a decade of silence, Gaddafi reemerged in November 2021 to register as a presidential candidate.<a href=\"#_ftn10\" name=\"_ftnref10\">[10]<\/a> \u00a0\u00a0While he was initially disqualified for his prior conviction, he successfully appealed the disqualification and is permitted to run for Libyan presidency.\u00a0 While considered to be a controversial candidate, Gaddafi is thought to appeal to voters among certain tribes and regions which benefited under his father.<a href=\"#_ftn11\" name=\"_ftnref11\">[11]<\/a><\/p>\n<p>&nbsp;<\/p>\n<p><em>Complications to the election process<\/em><\/p>\n<p>Saif al-Islam Gaddafi is one of numerous divisive candidates for the Libyan presidential election.\u00a0 Khalifa Haftar, commander of the Libyan National Army, was originally disqualified from the race for his prior conviction of war crimes committed during the civil war.<a href=\"#_ftn12\" name=\"_ftnref12\">[12]<\/a>\u00a0 Like Gaddafi, Haftar appealed his disqualification and was permitted by the Tripolis Appeal Court to run as a presidential candidate in the election.<a href=\"#_ftn13\" name=\"_ftnref13\">[13]<\/a>\u00a0 Abdul Hamid al-Debeibah, leader of the interim government, also added his name to the list of candidates despite his pledge to not run for the presidency.<a href=\"#_ftn14\" name=\"_ftnref14\">[14]<\/a>\u00a0 Due to a number of court cases against candidates such as Gaddafi, the electoral commission has yet to announce a finalized list of candidates for the election poll.<a href=\"#_ftn15\" name=\"_ftnref15\">[15]<\/a><\/p>\n<p>&nbsp;<\/p>\n<p>It is still unknown when the presidential election will take place.
