Khan QC <a href=\"https:\/\/www.icc-cpi.int\/Pages\/item.aspx?name=20220225-prosecutor-statement-ukraine\">issued a statement on the situation in Ukraine.<\/a>, He said he has been \u201cclosely\u00a0 following recent developments in and around Ukraine with increasing concern.\u201d\u00a0 On February 27, <a href=\"chrome-extension:\/\/efaidnbmnnnibpcajpcglclefindmkaj\/viewer.html?pdfurl=https%3A%2F%2Fwww.icj-cij.org%2Fpublic%2Ffiles%2Fcase-related%2F182%2F182-20220227-PRE-01-00-EN.pdf&amp;clen=194042&amp;chunk=true\">Ukraine filed\u00a0 an\u00a0 application instituting\u00a0 proceedings\u00a0 against\u00a0 the Russian\u00a0 Federation<\/a>\u00a0 before\u00a0 the International\u00a0 Court\u00a0 of\u00a0 Justice (ICJ) concerning\u00a0 \u201ca dispute\u00a0 .\u00a0 .\u00a0 .\u00a0 relating\u00a0 to\u00a0 the interpretation, application\u00a0 and\u00a0 fulfilment of\u00a0 the\u00a0 1948\u00a0 Convention on the\u00a0 Prevention and Punishment of\u00a0 the\u00a0 Crime\u00a0 of\u00a0 Genocide\u201d (the \u201cGenocide Convention\u201d).<\/p>\n<p><em>The International Criminal Court<\/em><\/p>\n<p>Mr. Kahn reminded all sides conducting hostilities in Ukraine that on September 8, 2015, the Ukraine government accepted jurisdiction of the ICC.\u00a0 Hence, his Office can exercise its jurisdiction over and investigate any act of genocide, crimes against humanity or war crime committed within the territory of Ukraine since February 20, 2014.<\/p>\n<p>The statement underscored that \u201c(a)ny person who commits such crimes, including by ordering, inciting, or contributing in another manner to the commission of these crimes, may be liable to prosecution before the Court, with full respect for the principle of complementarity.\u00a0 It is imperative that all parties to the conduct respect their obligations under humanitarian law.\u201d<\/p>\n<p>According to Mr. Khan, his office has received multiple inquires with respect to <a href=\"https:\/\/crimeofaggression.info\/role-of-the-icc\/definition-of-the-crime-of-aggression\/\">the crime of aggression<\/a> and the application of this crime to the situation.\u00a0 However, since neither Ukraine nor the Russian Federation are States Parties <a href=\"http:\/\/chrome-extension:\/\/efaidnbmnnnibpcajpcglclefindmkaj\/viewer.html?pdfurl=https%3A%2F%2Fwww.icc-cpi.int%2Fresource-library%2Fdocuments%2Frs-eng.pdf&amp;clen=381805&amp;chunk=true\">to the Rome Statute<\/a>, the Court cannot exercise jurisdiction over this alleged crime in this situation.<\/p>\n<p>Mr. Khan promised that his office will continue to closely monitor the Situation in Ukraine.\u00a0 His Office, h explained, remains fully committed to the prevention of atrocity crimes and ensuring accountability for anyone responsible for such crimes.<\/p>\n<p>Mr. Khan said he intends to issue a more detailed statement regarding the Situation in Ukraine on his return from a mission in Bangladesh.<\/p>\n<p><em>The ICC\u2019s Preliminary Examination on the Situation in Ukraine<\/em><\/p>\n<p>On\u00a0<a href=\"https:\/\/www.icc-cpi.int\/Pages\/item.aspx?name=201211-otp-statement-ukraine\"> December 11, 2020<\/a>, the Prosecutor announced the completion of her preliminary examination of the situation in Ukraine.\u00a0 The Prosecutor concluded a reasonable basis exists to believe that war crimes and crimes against humanity were committed.\u00a0 The next step in the judicial process is to request authorization from the Pre-Trial Chamber to open an investigation into the situation in Ukraine.\u00a0 In the interim, the Office continues to take measures to preserve the integrity of any future investigation into the situation in Ukraine.<\/p>\n<p>On\u00a0 April 25, 2014, the Office of the Prosecutor (OTP) \u00a0<a href=\"https:\/\/www.icc-cpi.int\/Pages\/item.aspx?name=pr999\">announced<\/a>\u00a0 a preliminary examination of the situation in Ukraine. \u00a0On September 29, 2014,, the Prosecutor\u00a0<a href=\"https:\/\/www.icc-cpi.int\/Pages\/item.aspx?name=pr1156\">announced<\/a>, based on Ukraine&#8217;s second declaration under article 12(3), the extension of the preliminary examination of the situation in Ukraine to include alleged crimes occurring after February 20, 2014. The OTP has received many communications under article 15 of the Rome Statute in relation to the &#8220;Maidan protests&#8221; as well as to events in Crimea and eastern Ukraine.<\/p>\n<p>The preliminary examination initially targeted alleged\u00a0crimes against humanity\u00a0committed in the context of the &#8220;Maidan&#8221; protests which occurred in Kyiv and other regions of Ukraine between November 21, 2013 \u00a0and\u00a0 February 22, 2014.<\/p>\n<p>The OTP concluded a reasonable basis exists to believe that a broad range of grave conduct constituting war crimes and crimes against humanity were committed.\u00a0 The OTP also found that the alleged crimes identified would currently be admissible, and thus there was a reasonable basis for investigation, subject to judicial authorization.<\/p>\n<p><em>The International Court of Justice<\/em><\/p>\n<p><a href=\"https:\/\/www.icj-cij.org\/en\/case\/182\">Ukraine\u2019s application <\/a>\u00a0accuses\u00a0 the\u00a0 Russian\u00a0 Federation of\u00a0 \u201cplanning\u00a0 acts\u00a0 of\u00a0 genocide in Ukraine\u201d\u00a0 and contends\u00a0 that\u00a0 Russia\u00a0 \u201cis\u00a0 intentionally killing\u00a0 and inflicting\u00a0 serious\u00a0 injury on members of\u00a0 the\u00a0 Ukrainian nationality\u00a0 \uf8e7\u00a0 the\u00a0 <em>actus reus<\/em>\u00a0 of\u00a0 genocide\u00a0 under\u00a0 Article\u00a0 II of the\u00a0 <a href=\"http:\/\/chrome-extension:\/\/efaidnbmnnnibpcajpcglclefindmkaj\/viewer.html?pdfurl=https%3A%2F%2Fwww.un.org%2Fen%2Fgenocideprevention%2Fdocuments%2Fatrocity-crimes%2FDoc.1_Convention%2520on%2520the%2520Prevention%2520and%2520Punishment%2520of%2520the%2520Crime%2520of%2520Genocide.pdf&amp;clen=44165&amp;chunk=true\">[Genocide] Convention<\/a>\u201d. The Applicant\u00a0 seeks\u00a0 to found the\u00a0 Court\u2019s\u00a0 jurisdiction on Article\u00a0 36,\u00a0 paragraph\u00a0 1, of\u00a0 the\u00a0 Statute of\u00a0 the\u00a0 Court\u00a0 and on Article\u00a0 IX of\u00a0 the Genocide Convention,\u00a0 to\u00a0 which\u00a0 both\u00a0 States are parties.<\/p>\n<p><a href=\"https:\/\/www.icj-cij.org\/en\/case\/182\">Ukraine asked the ICJ to order Russia provisionally<\/a> to halt its military operations in Ukraine, in order to prevent \u201cirreparable prejudice to the rights of Ukraine and its people\u201d and to avoid \u201caggravating\u201d the dispute between the two countries, both parties to the Genocide Conventions.<\/p>\n<p>It also disputed Russia\u2019s claims of genocide organized by Ukraine in the Luhansk and Donetsk separatist regions, which the Russian president, Vladimir V. Putin, used to justify for the invasion.<\/p>\n<p>Already the ICJ has a case brought by Ukraine against Russia in 2017, accusing it of furnishing funds, weapons and training to illegal armed groups in the eastern Donbass region and of discriminating against the Crimean Tatar and ethnic Ukrainian communities in Crimea.\u00a0 <a href=\"https:\/\/carnegieeurope.eu\/2017\/03\/15\/revisiting-2014-annexation-of-crimea-pub-68423\">Russia annexed Crimea in 2014<\/a>.<\/p>\n<p><em>Analysis<\/em><\/p>\n<p>The two cases in the ICJ and the statement by the ICC Prosecutor are two tangible cases arising from the Russian \u2013 Ukraine conflict.<\/p>\n<p>On February 25, <a href=\"https:\/\/www.amnesty.org\/en\/latest\/news\/2022\/02\/russian-military-commits-indiscriminate-attacks-during-the-invasion-of-ukraine\/\">Amnesty International issued a statement<\/a>, underscoring that the Russian invasion of Ukraine \u201chas been marked by indiscriminate attacks on civilian areas and strikes on protected objects such as hospitals.\u201d\u00a0 Amnesty International documented three incidents that it believes to have killed at least six civilians and injured at least 12 more. Indiscriminate attacks violate international humanitarian law (the laws of war) and can constitute war crimes.<\/p>\n<p>Amnesty International\u2019s Crisis Evidence Lab analyzed digital evidence, including photos, videos and satellite imagery, of three such attacks.\u00a0 The attacks allegedly occurred in the early hours of the Russian invasion of Ukraine on February 24.
