{"id":2216,"date":"2025-05-30T17:24:56","date_gmt":"2025-05-30T21:24:56","guid":{"rendered":"https:\/\/ielrblog.com\/?p=2216"},"modified":"2025-05-30T17:24:56","modified_gmt":"2025-05-30T21:24:56","slug":"u-s-treasury-and-state-provide-immediate-sanctions-relief-for-syria","status":"publish","type":"post","link":"https:\/\/ielrblog.com\/index.php\/2025\/05\/30\/u-s-treasury-and-state-provide-immediate-sanctions-relief-for-syria\/","title":{"rendered":"U.S. Treasury and State Provide Immediate Sanctions Relief for Syria"},"content":{"rendered":"<p>On May 23, 2025, the Department of the Treasury\u2019s Office of Foreign Assets Control (OFAC) issued Syria General License (GL) 25 to give immediate sanctions relief for Syria following President Trump\u2019s announcement of the lifting of all sanctions on Syria. <a href=\"\/https:\/ofac.treasury.gov\/media\/934306\/download?inline\">General License (GL) 25<\/a> authorizes transactions forbidden by the Syrian Sanctions Regulations, effectively removing sanctions on Syria. GL 25 will facilitate new investment and private sector activity. Concurrently, the U.S. Department of State is issuing a waiver under the Caesar Syria Civilian Protection Act (Caesar Act)<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a> to enable foreign partners, allies, and the region to support Syria.<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a><\/p>\n<p><em>OFAC and GL 25<\/em><\/p>\n<p>GL 25 is an important initial move to implement President Trump\u2019s announcement on May 13 concerning the lifting of sanctions on Syria. GL 25 will enable activity across all sectors of the Syrian economy, without furnishing relief to terrorist organizations, persons violating human rights and war crimes, drug traffickers, or the former Assad regime. It does not permit transactions that benefit Russia, Iran, or North Korea, as these countries were avid supporters of the former Assad regime.<\/p>\n<p>GL 25 authorizes transactions that would otherwise be prohibited under economic sanctions on Syria, including new investment in Syria, the furnishing of financial and other services to Syria; and transactions concerning Syrian-origin petroleum or petroleum products. GL 25 also authorizes all transactions with the new government of Syria, and with certain blocked persons identified in an Annex to the GL.<\/p>\n<p>The Financial Crimes Enforcement Network (FinCEN) is also giving exceptive relief to allow U.S. financial institutions to maintain correspondent accounts for the Commercial Bank of Syria.<\/p>\n<p>OFAC plans to issue further guidance related to GL 25.<\/p>\n<p><em>FinCEN Issues Exception to Prohibition Imposed by \u00a7 311 of the USA PATRIOT Act against the Commercial Bank of Syria<\/em><\/p>\n<p>FinCEN is providing exceptive relief under 31 U.S.C. \u00a7 5318(a((7) and 31 C.F.R. \u00a7 1010.970 to covered financial institutions for requirements pursuant to 31 C.F.R. \u00a7 1010.653 (FinCEN\u2019s rule imposing special measures against the Commercial Bank of Syria). This relief allows covered financial institutions to open and maintain correspondent accounts for the Commercial Bank of Syria (CBoS) under certain conditions. FinCEN may make exceptions that are conditional or unconditional, may apply to particular persons or classes of persons, and may apply to particular transactions or classes of transactions. In addition, an exception can be issued or revocable in the sole discretion of the Secretary of the Treasury, based on the circumstances to which the exception applies.<\/p>\n<p>The exceptive relief does not waive or alter the due diligence obligations for covered financial institutions under \u00a7 312 of the USA PATRIOT Act and its implementing regulation (31 C.F.R. \u00a7 1010.610).<\/p>\n<p><em>Analysis<\/em><\/p>\n<p>The Treasury Department said that the sanctions relief occurred with \u201cthe understanding that the country will not offer a safe haven for terrorist organizations and will ensure the security of its religious and ethnic minorities.\u201d Treasury added that \u201cthe U.S. will continue monitoring Syria\u2019s progress and development on the ground.\u201d<a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a><\/p>\n<p>On May 20, the European Union\u2019s foreign policy chief Kaja Kallas announced that the EU has decided to lift economic sanctions on Syria. In February, the EU softened sanctions on Syriato support \u201can inclusive political transition.\u201d<a href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a>\u00a0 The EU said it would continue weapons-related sanctions \u201cbased on security grounds, including arms and technology that might be used for internal repression.\u201d<a href=\"#_ftn5\" name=\"_ftnref5\">[5]<\/a><\/p>\n<p>Om May 20, Secretary of State Rubio warned the Senate Foreign Relations Committee that the U.S. decided to lift sanctions because U.S. officials believed that Syria was in imminent danger of sliding back into something like the bloody ethnic fighting that plagued the country until Assad\u2019s fall.<a href=\"#_ftn6\" name=\"_ftnref6\">[6]<\/a><\/p>\n<p>The U.S. and EU lifting sanctions goes against Israel\u2019s approach.
