{"id":858,"date":"2019-02-08T21:43:43","date_gmt":"2019-02-08T21:43:43","guid":{"rendered":"http:\/\/ielrblog.com\/?p=858"},"modified":"2019-02-11T21:47:50","modified_gmt":"2019-02-11T21:47:50","slug":"new-article-on-the-cloud-act-in-english-and-french","status":"publish","type":"post","link":"https:\/\/ielrblog.com\/index.php\/2019\/02\/08\/new-article-on-the-cloud-act-in-english-and-french\/","title":{"rendered":"New Article on the CLOUD Act in English and French"},"content":{"rendered":"<p>My colleague Anna Gressel and I have written an article, published in the current <em>ABA Litigation Journal<\/em>, which attempts to make sense out of the CLOUD Act adopted by the US Congress last year.\u00a0 You will find it <a href=\"https:\/\/www.debevoise.com\/insights\/publications\/2019\/02\/storm-clouds-or-silver-linings\">here<\/a>.\u00a0 (For French-speakers, a copy in that language is <a href=\"https:\/\/media.debevoise.com\/email_handler.aspx?sid=blankform&amp;redirect=https%3a%2f%2fwww.debevoise.com%2f%7e%2fmedia%2ffiles%2finsights%2fpublications%2f2019%2f01%2fstorm_clouds_or_silver_fr.pdf\">here<\/a>).<\/p>\n<p>The Act addresses an intriguing and difficult issue: how should national criminal and privacy laws deal with so-called \u201cdeterritorialized\u201d data?\u00a0 Traditionally, laws protecting privacy have been <u>local<\/u>: there is an intuitive connection between the place where I am or store things and the laws that protect me and my information.\u00a0 So to arrest me, or get access to my home or papers, the local police must turn to local procedures that restrain their conduct.\u00a0 But today, the physical location of data is often meaningless: sensitive, important information that I easily access and handle in my home or office may be stored in a distant country, or may have no identifiable location at all &#8212; some service providers automatically divide even simple emails into \u201cshards\u201d that are constantly redistributed among servers in different countries to achieve efficiency.\u00a0 So if my most precious personal and financial information is stored someplace \u201cin the cloud,\u201d what country\u2019s laws protect it?<\/p>\n<p>The Supreme Court was faced with this question in March 2018 in a case where Microsoft was ordered to turn over emails to which it could easily gain access in the US, but which were physically stored on a server in Ireland because the account holder was from there.\u00a0 The core question was whether Ireland had an interest in regulating police access to data stored on its territory, or whether US investigative authorities could simply go ahead and get an order for their production in the US without even informing Ireland.\u00a0 On this the parties and scores of <em>amici curiae<\/em> were starkly divided.\u00a0\u00a0 Before the question could be decided, however, Congress passed the CLOUD Act, which mooted the pending case.\u00a0 The Act\u2019s core provision is that if a service provider in the United States is appropriately ordered to turn over information to which it has <u>access<\/u>, it must do so no matter where the information is stored \u2013 <u>unless<\/u> it can show that the data involved is stored in a friendly country whose privacy laws would thereby be violated.\u00a0 The CLOUD Act\u2018s substitution of <u>access location<\/u> for <u>storage<\/u> <u>location<\/u>, coupled with international coordination, is certainly an innovative, and probably a positive, step forward.\u00a0 The key may be whether other countries ultimately pursue the invitation to work with US lawmakers and investigators, or come up with an alternative, so that an appropriate and internationally acceptable balance can be found.<\/p>\n<p>I would be especially interested in thoughts any of you may have about whether this approach is likely to gain support in your own communities.<\/p>\n<p>___<\/p>\n<p><em>Fred Davis is Of Counsel in the New York and Paris offices of Debevoise &amp; Plimpton LLP, and a member of the New York and Paris Bars.\u00a0 He is also a Lecturer in Law at Columbia Law School where he teaches courses on comparative criminal procedures and cross-border criminal investigations.\u00a0 His book <\/em>American Criminal Justice: An Introduction<em> will be published soon by the Cambridge University Press.<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>My colleague Anna Gressel and I have written an article, published in the current ABA Litigation Journal, which attempts to make sense out of the CLOUD Act adopted by the US Congress last year.\u00a0 You will find it here.\u00a0 (For French-speakers, a copy in that language is here).
